Spring Adventure 2025 Campaign Contest Rules

ENTER DAILY MAY 8, 2025 – MAY 19, 2025 FOR A CHANCE TO WIN.* WINNERS RANDOMLY DRAWN ON MAY 20, 2025.

NO PAYMENT OR PURCHASE IS NECESSARY TO ENTER THE CONTEST. ENTRY IS VIA CONTEST KIOSKS IN WOODGROVE CENTRE. YOU MUST BE 19 YEARS OF AGE OR OLDER TO ENTER. ENTRIES ARE ONLY OPEN TO RESIDENTS OF VANCOUVER ISLAND, (INCLUDING GULF ISLANDS AND SUNSHINE COAST COMMUNITIES), IN THE PROVINCE OF BRITISH COLUMBIA, CANADA.

EACH PARTICIPANT AGREES TO THESE OFFICIAL RULES OF THE CONTEST.

EMPLOYEES, OFFICERS AND DIRECTORS OF SPONSOR, INCLUDING RETAILERS WITHIN WOODGROVE CENTRE, AND THEIR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS, SUBSIDIARIES, AFFILIATES, ADVERTISING, AND PROMOTIONAL AGENCIES, AND THEIR IMMEDIATE FAMILIES (DEFINED AS PARENTS, SPOUSES, CHILDREN, SIBLINGS, GRANDPARENTS, AND THEIR RESPECTIVE SPOUSES) OR MEMBERS OF THE SAME HOUSEHOLD (WHETHER RELATED OR NOT) OF EACH SUCH EMPLOYEE, OFFICER AND DIRECTOR, ARE NOT ELIGIBLE TO ENTER.

1 – SPONSOR

The Contest is sponsored by Central Walk Woodgrove Shopping Centre Inc., 6631 Island Highway North, Unit 102, Nanaimo, B.C., V9T 4T7.

2 – CONTEST PARTIES

Contest Parties include “Sponsor” subsidiaries, affiliates, nominees, parent companies and media agencies. They include but are not limited to Central Walk Woodgrove Shopping Centre, VI Powersports AND Sport Chek.

3 – ELIGIBILITY

The Woodgrove Centre SPRING ADVENTURES 2025 (“the Contest”) is open to legal residents of Vancouver Island, (including Gulf Islands and Sunshine Coast Communities) in the province of British Columbia who: (i) are over the age of majority in British Columbia (19+) at the time of entry; except employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of Central Walk Woodgrove Shopping Centre Inc., VI Powersports AND Sport Chek (collectively, the “Contest Parties”).   By participating, you signify that you have read, accept, and agree to be legally bound by the terms and conditions of these Official Rules and Regulations (the “Rules”).

4 – HOW TO ENTER THE CONTEST

(a) To participate in the Contest, you must enter at the contest kiosks located at Woodgrove Centre May 8, 2025 – May 19, 2025, during Centre hours. Contest kiosks are located near in centre court by the prize display. Fully complete the entry form, which requires you to: (i) enter your data fields, e.g. full name, age, phone number, email address, and (ii) questions/preferences/opt-ins e.g. would you like to subscribe to the e-newsletter.  Then, participants will be automatically entered for a chance to win the grand prize.

(b) There is a limit of one entry per person per day.

CONTEST ENTRIES ARE MONITORED AND IF THERE ARE MULTIPLE SUBMISSIONS FROM ONE PARTICIPANT IN A SINGLE DAY, THOSE SUBMISSIONS WILL BE REVIEWED AND STAND THE RISK OF BEING DISQUALIFIED.

(c ) All submitted entries information exclusively becomes the property of the Sponsor. The Sponsor shall have the perpetual, irrevocable, world-wide and fully-transferable right (but not obligation) to use, modify, display, reproduce, make derivative works of for promotional purposes in any manner or media whether now or hereafter existing and/or to otherwise use or commercially exploit any entry (or any part thereof) or information or ideas contained within any entry, all without further payment, consideration, attribution, notice or consent. Entries generated by a computer program, robotic or other automated means will be disqualified.

(d) Sponsor will not be liable for entries that are incomplete, illegible, corrupted, false, lost or late or otherwise not in compliance with these Rules of the Contest. These entries may be disqualified from the Contest at the Sponsor’s sole discretion.

5 – ENTRY/SUBMISSION PERIOD

The Contest entry period will run from Thursday, May 8, 2025, (open 10:00 am PST) to Monday May 19, 2025 (closing 6:00pm PST) (the “Entry Period”), during regular Woodgrove Centre hours of operation (PST). All entries must be received within this Entry Period to be eligible for a chance to win the Grand Prize. Proof of submission does not constitute proof of receipt.

Centre Hours (PST):

  • Monday – Wednesday: 10am – 6pm
  • Thursday – Friday: 10am – 8pm
  • Saturday: 10am – 6pm
  • Sunday: 11am – 5pm

 

6 – CONTEST WINNER SELECTION, NOTIFICATION AND PRIZE REDEMPTION

(a) On or about 12:00 PM PST, Tuesday, May 20, 2025, three (3) eligible Entries will be selected (“the Selected Entry”) by random draw from all the eligible Entries received during the Contest Period in accordance with these Rules and Regulations.

(b) The Contest Organizer or its designated representative will contact the participant corresponding to the Selected Entry by phone or email (using the information provided at the time of Entry) (such participant referred to as the “Potential Winner”). If the Contest Organizer or its designated representative are unable to contact the Potential Winner by Thursday, May 22, 2025, or if there is a return of any notification as undeliverable, such Potential Winner will be disqualified at the Contest Organizer’s sole and absolute discretion and the Potential Winner will forfeit all rights to the Prize. Each Potential Winner will have forty-eight (48) hours from the time of first notification as set forth above to respond, as directed in the notification. A non-response by a finalist or non-receipt of notification response after the specified forty-eight (48) hours will be considered forfeiture.

The Contest Organizer may in its sole and absolute discretion, hold another random draw to select another eligible Entry from among the remaining eligible Entries, in which event the foregoing provisions herein shall apply to such newly selected Potential Winner.

(c ) Before being declared a confirmed Prize Winner (the “Winner”), the Potential Winner must successfully answer a skill-testing question unaided and unassisted and present government-issued photo identification verifying the residency and age of the Potential Winner and sign a Declaration and Waiver of Responsibility Form.

(d) If a Potential Winner (i) fails to correctly answer the skill-testing questions, (ii) fails to return the properly executed Declaration and Waiver of Responsibility Form, (iii) cannot accept, or is unwilling to accept the Prize as awarded for any reasons, (iv) fails to claim the Prize Saturday, May 24, 2025 or

(e) is determined to be in violation of these Rules and Regulations, all as determined by the Contest Organizer in its sole and absolute discretion, he or she may be disqualified (and if disqualified, will forfeit all rights to the Prize) and the Contest Organizer reserves the rights to select an alternate Potential Winner for the Prize in accordance with the procedures outlined in these Rules and Regulations, in which case the foregoing provisions will apply to such newly selected Potential Winner.

 

7 – PRIZE PACKAGE

(a) The Contest offers the chance to win one (1) of three (3) “Prize Packages”:

(b) The Prizes are non-transferable and non-assignable, and is not refundable, and must be accepted as awarded. Prizes shall have no redeemable cash value.
(c ) Each participant is eligible to win only one (1) of the three (3) Prize Packages. Once a participant has been selected as a winner for any Prize Package, they will no longer be eligible for the remaining draws.

8 – ODDS

The odds of winning one (1) of the three (3) prizes depends on the total number of eligible Entries received during the Contest Period.

9 – GENERAL CONDITIONS

The Sponsor reserves the right, in its sole direction, to terminate, modify or suspend the Contest if, in the Sponsor’s sole opinion, there is any suspected or actual evidence of tampering with any part of the Contest, or if viruses, bugs, unauthorized intervention, fraud, technical difficulties, acts of God or failures or any other factor beyond Sponsor’s reasonable control corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest.

The Sponsor is not responsible for any changes or unavailability of the contest application service that may interfere with the Contest (including any limitations, any restrictions, or any conditions on Sponsor’s ability to use the Service for the Contest as set forth herein that are not acceptable to Sponsor) or ability of a participant to timely enter, receive notices or communicate with the Sponsor, in which case the Sponsor, in its sole discretion, may terminate the Contest.

The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or to be acting in violation of these Rules of Contest or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any website/application or undermine the legitimate operation of the Contest is a violation of criminal and civil laws, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Rules of Contest shall not constitute a waiver of that provision or any other provision of these Rules of Contest.

10 – RELEASE

By entering the Contest, participants agree to be bound by these Rules and Regulations and the decisions of the Contest Organizer, which decisions are final with respect to all matters relating to the Contest.

By entering the Contest, each participant irrevocably releases, in perpetuity, and holds harmless the Sponsor and their respective parents, subsidiaries, affiliates, agents, and all of the respective employees, directors, and agents of the foregoing from and against all claims, damages or liabilities arising in whole or in part, directly or indirectly, from participant’s participation and/or entry in the Contest and/or participant’s award, receipt or use of any prize awarded in the Contest.

11 – PUBLICITY

Except where prohibited by law, participation in the Contest constitutes participant’s consent to the Sponsor’s (and its designees’, successors’ and assigns’) use of participant’s name, biography, likeness, voice, photographs, video, opinions, statements, hometown, province and country for promotional purposes in any manner or media (including, without limitation, online), worldwide, in perpetuity, and without further payment, consideration, notice or consent.

12 – LIMITATIONS OF LIABILITY

The Sponsor is not responsible for:

(a) incorrect or inaccurate transcription of entry information or late, lost, stolen, unintelligible, illegible, damaged, mutilated, altered, incomplete, or misdirected entries or entries received through impermissible or illegitimate channels, all of which will be disqualified;

(b) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer online systems, computer equipment, website/application, server provider, network, hardware or software;

(c ) the unavailability or inaccessibility of any website/application or service;

(d) unauthorized intervention in any part of the entry process or the Contest;

(e) printing, typographical, electronic or human errors which may occur in the offer or administration of the Contest or the processing of entries.

13 – DISPUTES

Participant agrees that:

(a) any and all disputes, claims, and causes of action arising out of or connected with the Contest, or the prize awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in a federal or provincial court located in British Columbia, Canada; participant submits to sole and exclusive personal jurisdiction to said courts in the Province of British Columbia for any such dispute and irrevocably waives any and all rights to object to such jurisdiction;

(b) any and all claims, judgments, and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering the Contest but in no event attorneys’ fees; a

(c ) under no circumstances will participant be permitted to obtain awards for and participant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules of Contest, or the rights and obligations of participant or Sponsor in connection with the Contest shall be governed by, and construed in accordance with, the laws of the Province of British Columbia, without giving effect to any choice of law or conflict of law rules of provisions (whether of the Province of British Columbia, Canada, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of British Columbia.
